Process Upon Receipt of Infringement Notice

Upon receipt of a valid infringement notice, Paintarium.com will take the following steps:

  1. Promptly remove or disable access to the material alleged to be infringing.
  2. Notify the content provider, member, or user that we have removed or disabled access to the material.
  3. Repeat offenders will have the infringing material removed from the website, and Paintarium.com will terminate such content provider’s, member’s, or user’s access to the service.

Counter-Notice

If you believe that the material you posted on Paintarium.com was removed or disabled by mistake or misidentification, you may send us a counter-notice containing the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Paintarium.com may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
